Terms and Conditions

JENNINGS TRAVEL LIMITED trading as You Travel NAPIER – AGENT booking

These Terms

The Terms. Please carefully read the following terms and conditions ("Terms") before using our services or having us create any bookings for you.  All documentation issued by us is subject to these Terms, and if applicable, the terms and conditions of the Service Providers (see clause 2.4 below).

Website.  If you are using our website, our website terms and conditions will also apply (see https://www.youtravelnapier.co.nz/terms-conditions ) but these Terms prevail if there is any inconsistency.

Who We Are

You and us.  The words "we", "our" and "us" refer to the agency named above.  The words "you" and "your" refer to the person who, by agreeing to these terms, appoints us as their agent to create bookings for them with Service Providers.  You confirm that you have the authority to give us instructions on behalf of each person listed in a booking.

YOU Travel. YOU Travel is one of New Zealand’s largest and most successful travel industry chains.  Each store is individually owned and operated to deliver a personal experience to you and forms part of the co-operative industry group aligned to the First Travel Group.  First Travel Group has long standing commercial relationships with most global airlines and land suppliers, enabling YOU Travel to provide you with the best choice of products available.

TAANZ. Each YOU Travel agency member is bound and bonded by the Travel Agents Association of NZ (TAANZ) Constitution. This bonding requirement ensures your funds are better protected.

Service Providers.  We are your agent and not the provider of the services and products you have requested.  We refer to these providers, such as airlines, tour operators, hoteliers, car rental providers and the like as "Service Providers" in these Terms.  When we create bookings for you, we are doing so as your agent, so the contract for those services is directly between youand the Service Provider.  All bookings are therefore made subject to the Service Provider’s own terms and conditions, including conditions of carriage and limitations of liability and you must check these carefully.  Your legal rights in connection with the provision of travel services are against the specific Service Provider.  We are not liable to you for loss of any kind which arises from the act, omission or default on the part of a Service Provider.  We are also not responsiblefor the content of any material or promotion supplied by or derived from Service Providers and shall not be liable for any direct or indirect loss or damage suffered by you (or any other party) from accessing, using, relying on or trading with such Service Providers.

Passport, Visa and Entry Requirements

Prior to requesting that we create your bookings.  Please forward a copy of the photo page of all travellers' passports prior to requesting that we create bookings on your behalf, so that we can ensure that we spell all travellers' names correctly.  Please note that it is your responsibility to ensure that all documentation matches the passport for each traveller on the booking. Any charges or cancellations associated with errors will be borne by you.

Passport requirements.  Many countries require your passport to be valid for 6 months, or more, beyond the expected date that you return, and for most countries you must have a machine-readable passport.  Your passport must be in good condition, if it is damaged or excessively worn it may not be valid.

Visa requirements and visa waivers.  Visas are required for many countries and must be obtained prior to arrival into that country.  Criminal convictions and previous contagious diseases may affect your entry into certain countries.  Visas can take varying times to obtain and while we assist with obtaining visas it is your responsibility to apply for visas in time prior to travelling.  An electronic visa waiver program is in place for the United States of America and Canada on dedicated websites.  These mustbe obtained by every traveller on the booking and these waivers can expire.  It is your responsibility to make sure you have a current visa waiver.

Re-entry visa.  We also require a copy of your New Zealand re-entry visa if you are not travelling on a New Zealand or Australian passport.

Pandemic, Epidemic measures (e.g., Covid-19).  Pandemic orepidemic conditions (such as those related to Covid-19) in countries that you are travelling to, from or through, must be checked by you, including those which restrict your return to New Zealand. We are not responsible should your travel be refused, interrupted, changed or delayed because of epidemic or pandemic measures.

General travel documentation.  You are responsible for obtaining all passport, visa and health information and all correct and necessary documentation for each passport holder travelling on the booking.  We will assist you to obtain such information on request, however the final responsibility for obtaining the necessary information and complying with any of these requirements remains with you.  When assisting with international travel bookings, we will assume that all travellers on the bookings have a valid New Zealand passport.

Other Travel Requirements

Inoculation requirements.  Some countries may require a valid inoculation certificate to enter or transit the country and it is your responsibility to obtain such certificates.

Mileage and loyalty.  Prior to requesting that we create bookings on your behalf, please provide us with all applicable airline mileage and loyalty schemes that you or any person on the booking belong to so these may be added to your reservations.  Please note that some reservations may not be eligible for rewards under mileage and loyalty schemes.  We reserve the right to charge a fee for mileage and loyalty scheme verification of travel already completed.

Credits, vouchers and loyalty points.  If you plan on using airline or other credits, vouchers or loyalty points to pay for your booking, make sure you let us know well before their expiry date.  We are not responsible if credits, vouchers or points expire before they can be used.

Baggage. Prior to requestingthat we create bookings on your behalf, please check that the baggage requirements of the relevant Service Provider are sufficient, as baggage allowances can differ between Service Providers (particularly for things like sports equipment or when your travel is on a smaller aircraft).

Travel advisory. We recommend that you check any travel and health warnings prior to requesting that we create bookings on your behalf.

Insurance.  We strongly recommend that you take out appropriate travel insurance to cover your travel arrangements.   If you purchase an insurance policy through us, we may receive a commission from the insurance provider for this.  If you do not take out insurance that is at your risk.

Pricing and Payment

Pricing. Unless otherwise stated, all prices are in New Zealand dollars and are inclusive of all pre-payable taxes including goods and services tax (GST) if applicable, airport taxes, fuel surcharges and insurance levies.  All taxes are subject to change without notice.  Prices do not include any items of a personal nature such as alcoholic beverages, gratuities, meals, transport from your home port, for example, unless otherwise indicated.

Availability.  All prices are subject to availability.  We are reliant on information supplied to us by Service Providers and other third parties.  Therefore, prices and availability may change after prices are offered to you and before you request that we create bookings on your behalf.

Specials.  Specials are available for a limited time.  You must check with us whether a special displayed on our website is still available.  There may be particular terms and conditions that apply to specials.  You must contact us or the relevant Service Provider to determine whether any particular terms and conditions apply.

Errors.  Every effort is made to ensure that all information and prices are complete and accurate but errors may occur from time to time.  We reserve the right to correct any errors or omissions, and any bookings based on an incorrect price will not be valid.  You will be advised of any such error at the earliest opportunity, and you will then have the option to pay the correct price or cancel and receive a full refund of any money already paid by you.  The price offered to you will be the price applicable to your bookings.

Booking Conditions

Bookings. No booking instruction from you will be binding on us until we have accepted it and confirmed to you.

Deposit.  We require a non-refundable deposit to confirm your acceptance of these Terms.  Once you have paid the deposit, we will create the bookings we have agreed to make on your behalf.  The deposit is part payment of the price of the bookings that we create for you.  The deposit may vary depending on the requirements of each Service Provider and their own terms and conditions.

Further Payments.  Payments for the balance of your bookings as set out in our advice to you must be made when due.  Failure to do so may result in cancellation of your bookings by us or a Service Provider and no compensation will be payable.  Cancellation fees may also be charged by Service Providers and us in accordance with these Terms.

Documentation.  Once we have received payment in full from you, tickets and documentation will be finalised and requested from the Service Provider.  Delivery of these tickets and documentation to you is dependent on each Service Provider.

Ticketing.  It is your responsibility to comply with each Service Provider’s ticketing and other terms and conditions.  We strongly recommend that you check these details with the Service Provider prior to travel.

Special requests.  Special requests will be passed on to the Service Provider but can never be guaranteed.  You should advise us of any special request no later than 7 days prior to your departure.

Urgent confirmation. If you require urgent confirmation of your bookings and we incur costs in obtaining that confirmation, those costs may be passed on to you.

Alterations by Service Providers.  We do not take responsibility for any change of departure time, booking number or other alterations made by Service Providers, including airlines.

Amendments and cancellations. Your ability to amend and cancel bookings is dependant on the terms and conditions applied by each Service Provider.  Cancelled or amended bookings may incur Service Provider fees, which can be up to 100% of the cost of the booking, regardless of whether travel has commenced, especially if tickets need to be re-issued or bookings redocumented.  Where we incur any liability for a Service Provider’s amendment or cancellation fee for any booking which you change or cancel, you agree to indemnify us for the amount of that fee.  We also reserve the right to charge our own fees for any amendments or cancellations, to cover commissions or other revenue forgone by us as a result of your amendment or cancellation, up to a maximum of 20% of the original cost of the booking.

Refunds.  Refunds will depend on the terms and conditions of each Service Provider.  Where you seek a refund for a cancelled booking for which payment has been made to the Service Provider, we will not provide a refund to you until we receive the cleared funds from that Service Provider.  Service Provider refund processing times vary and may take many months.  Service Providers also often deduct administration fees on refunds.

Chargeback Indemnity.  Where a booking is cancelled and you are entitled to a charge back to us on your credit card, and where we have already paid the sum being charged back, as your agent, to a Service Provider, you will indemnify us as your agent if we cannot recover that charge back amount from the Service Provider within 7 days.  We may separately charge the same credit card for this indemnity payment.  Where possible we will assist you to try to recover the amount directly from the Service Provider.  To avoid the need for chargebacks, we strongly recommend that you make fully refundable bookings where the option is available.

Service fee.  On occasions where we are unable to be remunerated by commission (or similar) from a Service Provider, we reserve the right to charge you a service fee for creating bookings on your behalf.

Disclaimers, Liability, and Your Indemnity

Insurance
*** IMPORTANT NOTES ON TRAVEL INSURANCE ***
Please note that upon acceptance of our travel proposal, and paying a deposit, some or all of the money paid will become non-refundable. It is very important that you take out travel cancellation insurance to cover your funds for cancellation due to unforeseen circumstances.
We are happy to give you a quote on this.
The amount of cover; how and when it is activated; your emergency number & procedure; policy excesses; “who” is covered; that pre-existing medical conditions are covered; policy age limits; and that it covers you for the whole duration of the trip. Please ensure that you have a copy of the policy wording before making your decision.
-  You should take travel insurance that at least covers cancellation / overseas medical costs / loss of baggage

*** IF YOU HAVE TO MAKE A CLAIM***

Once you have taken out Travel Insurance (through which ever provider), please ensure that you take a copy of the policy and the “Schedule of Benefits and Exclusions” with you so you know what you could claim for if you had to.

In the event of an incident, IT IS IMPERATIVE that you obtain written records, photo’s, and proof from official sources to substantiate your claim. Lack of proof will severely slow up the claim process.

  • For an airline delay, you would need a note from the airline verifying the delay.
  • For a medical claim, a note from the medical practitioner explaining what procedures were undertaken and why
  • For a lost bag – an airline lost luggage incident form, and a list of contents of the bag
  • For a damaged bag - an airline baggage incident form and photos of the damage
  • For stolen items, a Police report, or copy of the report from the accommodation provider

Passports & Visas

*** PASSPORTS ***

  • For all travel beyond New Zealand all travellers will require a valid passport. Many countries also require you to have at least 1 completely unused page in your passport.
  • Your tickets MUST be issued in exactly the same first & last name as in your passport. (Middle names are NOT required).
  • Many countries require your passport to be valid for more than six months beyond the expected date of your return, and for some countries you must have a machine-readable passport.
  • Your passport should be in good condition as if it is damaged or excessively worn it may not be valid for travel.

Useful Website: www.passports.govt.nz

*** VISA REQUIREMENTS ***

  • It is the passenger's responsibility to ensure they have the appropriate documentation including visas. We are happy to assist you in determining visa requirements wherever possible.
  • You will be required to obtain a visa from the country you intend to visit if you have a criminal conviction, or any contagious disease.
  • If you are not on a NZ/Australian passport, you require a re-entry permit to allow you back into New Zealand
  • Please note that all non-NZ/Australian passport holders (no matter how long that you have been in New Zealand for) require a visa to enter Australia.
  • No matter what passport you are on, some countries a valid visa will be required. These countries include (but are not
limited to): USA (including Hawaii), Vietnam, India, China, Russia

*** IMPORTANT NOTE ON TRAVELLING TO THE USA & CANADA ***

New Zealand Passport holders (and some other foreign passport holders can apply for the Visa authority via the following official web-links:

DO NOT GOOGLE the weblinks. Use the ones above. There are many scam sites. DO NOT PAY MORE THAN USD14.00 for a USA Visa.
If it asks for more than USD$14.00, it is a scam site.

Please endeavour to issue your USA ESTA & Canadian ETA Visa’s a FULL TWO MONTHS prior to travel. This advance time ensures that a margin of time is allowed for should there be any unexpected technicalities in issuing the Visa’s.

*** IMPORTANT NOTE ON TRAVELLING TO THE USA & CANADA ***

In new regulations to curb child trafficking, a recent change in requirements for travelling with children to South Africa & Brazil now requires that as well as passports, children must carry an unabridged Birth Certificate & a signed affidavit by both parents.
Travel Notes

*** IMPORTANT NOTE ON AIRFARE CHANGES & CANCELLATION ***

Please note that with 99% of airline bookings, once the ticket has been issued, airlines will charge fees to date change & route change. These fees can be high, depending on the fare conditions, and the new flight dates that you wish to book.

Fees will also apply for cancellations. These fees can be as much as 100% of the fare.

Name changes to a different person are not possible.

Please be very sure of your booking before you purchase your tickets and ensure that you take Travel insurance to cover
for unforseen circumstances.

*** IMPORTANT NOTE ON CRUISE & TOUR DEPOSITS & PAYMENTS***

Please note that Cruises and Tours require deposits to hold a space on the departure that you want. Once paid these deposits are non-refundable. Similarly, once full payment is made, this will generally be non-refundable as well.

It is imperative that you take travel insurance out at the time of paying your deposit.

*** IMPORTANT NOTE ON HEALTH PRECAUTIONS ***

If you are travelling to any parts of the world where health standards are considered to be less than in New Zealand, in particular if you are travelling to rural or jungle areas, please consult with your Doctor as to whether or not you will require any immunisations prior to arrival. Please ensure you check well in advance of your travel date.

The official NZ Government site has valuable information on up-to-date world issues that could affect your travel, as well as providing a register for Kiwi’s travelling overseas.
Weblink: https://www.safetravel.govt.nz/

*** IMPORTANT NOTE ON CRIMINAL CONVICTIONS & FINES ***

If you have a criminal record, there is a high probability that you will need a visa to travel to that (any) overseas country. Please ensure that you get clearance to travel to all countries BEFORE you buy your travel arrangements, as you may be refused entry. Your Travel Insurance will not cover cancellation due to criminal convictions or outstanding fines.

If you have outstanding fines, you could be stopped from travelling at the airport. To check this please call

Ph 0800PAYORSTAY
(PH 0800 729 677) or visit

*** IMPORTANT NOTE ON CURRENCY CHANGES***

Please note that most of our prices are subject to the changes of the currency markets. Many of our operators have small safety margins on currencies, but when large shifts in the dollar happen, we are given little (a few days) or no warning that your prices will increase.
The best way to avoid having to pay the additional currency surcharges is to pay for your holiday in full. Once paid in full, suppliers are
obligated to honour the rate that you paid on the day that you paid it.

It is also worth your while to keep an eye on exchange rates, and when you think that rates are the most favourable, buy your spending money (either in foreign cash, or add it to your Cash Passport).

*** IMPORTANT NOTE ON AIRLINE PRE-SEATING ***

Many airlines now only offer the option to choose specific seat numbers prior to check-in as a Paid option only. Seating is not guaranteed, even if paid for. Airlines try, but do not guarantee that everyone will be seated together.

Many things can happen in your travels to upset or alter your travel plans. It is very important to us that your trip goes as smoothly as possible. If you do encounter a problem with the plans that we have booked, we ask that you contact us immediately to allow
us to find a solution as quickly as possible.

Just call our office on +64 6 8353 917, outside of normal NZL business hours you will have the option to either leave a message that will be actioned on the next business day OR for emergencies there is an option to be connect directly to Stephen Jennings’s mobile which is monitored 24/7.

*** IMPORTANT NOTE ON FREQUENT FLYER PROGRAMMES ***

Before you travel, please give us any frequent flyer numbers that are relevant to your itinerary. Ensure to keep all boarding passes,
and any ticket copies as they may be required to claim any missed points.

It is imperative that you check and chase any missed points directly with the frequent flyer club within 1 month of the date of travel, it
is YOUR responsibility to do this. Your Travel consultant cannot retrieve points missed for any reason once the airline deadline has passed.

Do not throw away your boarding passes until you have checked that your points have arrived on your statement. Also, some very cheap fares do not allow you to accrue frequent flyer points.

*** AGENCY SERVICE FEE ***

On occasions where our agency is unable to be remunerated via a commission payable by a supplier we reserve the right to charge a service fee.

*** CANCELLATIONS & AMENDMENTS ***

Should change or cancel your booking there will be charges associated with the extra work and time required, up to a maximum of $500.00 per adult. In addition substantial fees may be charged by Service Providers, they will vary from one to another as well as depending upon the time at which you cancel or amend your arrangements.

The amount of each supplier’s cancellation or amendment fee is beyond our control and payment is solely your responsibility.

We reserve the right to retain the normal revenue value for the work already completed. Additionally, if you cancel your booking we reserve the right to retain the normal revenue value that we would receive if it weren't cancelled in relation to the work already completed up until the time of cancellation.

You may or may not be entitled to a refund depending upon the refund policies and conditions of the Service Provider(s). We suggest you consult the relative brochure or ask us for advise. If we obtain a refund on your behalf, please note that a fee may be applicable.

  5. We have no control over the products or services provided by Service Providers or the manner in which they are provided. We will nevertheless endeavour to ensure that they are suitable to meet the particular requirements you have made known to us.
  6. We cannot accept liability for loss of any kind which arises from any act, omission or default on the part of Service Providers. Neither can we accept responsibility for loss caused by Acts of God or force majeure such as (but not restricted to) weather or equipment disruptions, acts of government or other authorities, wars, hostilities, civil disturbances, strikes, riots, pilferage, medical or customs regulations or requirements.
  7. Travel is an individual experience and opinions and preferences differ from person to person. Individual satisfaction can be affected by many circumstances beyond our control (e.g. the weather) and we cannot be responsible if any aspect of your trip does not meet your expectations.
  8. We will take reasonable care and skill in selecting suppliers to ensure your safety and enjoyment but any adventure activity has some measure of risk and therefore all bookings are made on the condition that you will accept those risks and acknowledge that neither we nor any of our officers, employees, agents, subcontractors nor your fellow passengers shall be liable in any way for injury, loss, damage or claim of any kind to person or property, whether direct, consequential or compensatory, regardless of cause.
